1. Who operates VOUCH
1.1. VOUCH is operated by Luca Pace, a private individual established in Italy ("we", "us").
1.2. Write to us at slope.kauri8537@eagereverest.com about these terms, your account, or content you want to report. This is our single point of contact for users and for anyone else, whether or not they use VOUCH. We answer in English and Italian.
1.3. Courts and public authorities, including the Italian Digital Services Coordinator (AGCOM), can reach us at the same address, in English or Italian.
1.4. VOUCH is a free mobile application. The app and everything it provides are "the Service".
2. These terms
2.1. These terms are the agreement between you and us for the use of the Service. The Privacy Notice at https://vouch-app.io/privacy explains how we process personal data. It is not part of this contract, but read it before you start.
2.2. You accept these terms in the app before you start using VOUCH. We record when you accepted them. If you do not accept them, you cannot use VOUCH.
2.3. We may change these terms for a valid reason: a change in the law or in an authority's guidance, a new, changed or removed feature, security, the prevention of abuse, a change of operator under section 18, or to make them clearer. When we do, the app shows you the new version and asks you to accept it before you continue. If you do not accept it, you can delete your account, and the version you accepted before keeps applying to what happened while it was in force. A correction that does not change your rights or obligations, such as a typo, may be published without asking you again.
2.4. The current version is always available in the app and at https://vouch-app.io/terms. Earlier versions are available on request.
2.5. If a clause of these terms conflicts with a mandatory rule that protects you as a consumer in the country where you live, that rule prevails.
3. Who can use VOUCH
3.1. You must be at least 18 years old. There is no exception. You declare your date of birth when you sign up, and we rely on that declaration. Declaring a false date of birth is a serious breach of these terms. If we learn, or have reason to believe, that you are under 18, we close your account.
3.2. You must be able to enter a binding contract under the law of the country where you live.
3.3. One person, one account. You may not create an account for someone else, share your account, or create a new one after we have closed one of yours, unless we have agreed to it in writing.
3.4. The name and date of birth you give must be yours and accurate. Your nickname may be anything within the rules of section 9. What other users can see of your profile is described in the Privacy Notice.
4. Test phase
4.1. VOUCH is in a closed test phase. Access is by invitation only. The sign-in code we give you is personal: do not pass it to anyone.
4.2. Test software has bugs. Features may change, stop working or disappear between versions.
4.3. During the test phase we may reset the Service, delete any content, including albums, or end the test, at any time. We will tell you in the app beforehand where we reasonably can.
4.4. We do not promise that the Service will continue after the test phase, or that your account, badges or albums will carry over to a later version.
4.5. The test version is confidential. Do not publish or share, outside the people invited to the test, screenshots, recordings or descriptions of the app, its features or its design, unless we have agreed to it. This does not stop you from talking about your own experience of a gathering, reporting something to an authority, or seeking legal advice.
4.6. We may ask you for feedback. You never have to give it. We will tell you when the test phase ends.
5. What VOUCH does
5.1. VOUCH lets adults propose and join real-world gatherings nearby. In these terms:
- A drop is a proposal to gather in an area at a time. Other users can see it on the map. The person who creates it is its creator.
- Joining a drop is a commitment to go. Everyone who joins is a participant. A drop goes ahead only if enough people join it. Otherwise it expires.
- The chat of a drop is the conversation among its participants. It ends shortly after the drop ends and is then deleted. It is not archived, cannot be exported and cannot be recovered.
- A proof is a set of photographs taken in the app, with the device's cameras, at the gathering. It carries the place and time it was taken.
- Vouching is participants confirming that a proof is real.
- A proof confirmed by enough participants earns a badge. The badge opens the drop's album: the confirmed proofs of that drop. Only participants who hold a badge for that drop can open its album. An album has no expiry date, subject to sections 4 and 14.
5.2. How these features work in detail, for example how many people a drop needs, how many vouches a proof needs, or how long a chat stays open, is shown in the app and may change under section 14.
6. Your account
6.1. You sign in with your phone number and a code. Keep the code secret. Anyone who has both can act as you.
6.2. You are responsible for what is done through your account until you tell us it has been compromised. Write to us as soon as you suspect unauthorised use, and we will take reasonable steps to secure the account, including ending its sessions.
6.3. If you lose control of the phone number on your account, we may not be able to restore the account.
7. Your content
7.1. You own what you make. Your drops, messages, proofs, name and nickname ("your content") stay yours.
7.2. The licence we need. So that the Service can work, you give us a non-exclusive, royalty-free, worldwide licence to store, copy, resize, transmit and display your content, only to operate and secure the Service and only in the ways described in these terms and in the Privacy Notice. We do not use your content for advertising, we do not sell it and we do not license it to anyone else.
7.3. How long the licence lasts. As long as your content is on the Service. It ends when the content is deleted, except where the law requires us to keep something or section 15.1 says we keep it.
7.4. Proofs show other people. A proof taken at a gathering will often show other participants, and it can show the place and the people around it. By taking part in a drop you agree that your image may appear in the proofs of the other participants of that drop, and that those proofs are visible to the people who can see them under section 5. You are responsible for what your cameras capture. Do not take a proof that identifiably shows a person who is not a participant, and point the cameras away from bystanders where you can. If a proof shows you and you want it removed, write to us.
7.5. Removing your own proof. You can ask us at any time to remove your own proof from its album, by writing to us or from the app where the app offers it. Removal is permanent and applies to everyone.
7.6. Your responsibility. Your content must follow the rules in section 9. You confirm that you have the right to post it and that it breaks no law and no right of another person.
7.7. What we may do. We may remove or restrict content that breaks these terms or the law, or that we are ordered to remove. Section 10 explains how, and what you can do about it.
7.8. Chats are not kept. We do not monitor chats. A chat is deleted shortly after its drop ends, and we do not restore it, for you or for anyone else. Do not use the chat for anything you may need a record of.
8. Gatherings are yours, not ours
8.1. VOUCH is a tool, not an organiser. Every gathering is proposed, organised and attended by users. We do not organise, host, supervise, attend or endorse any gathering. We are not a party to anything that happens at one, or to any agreement between users.
8.2. If you create a drop, you are its organiser. You are responsible for:
- choosing a place you are allowed to use: a public space where a gathering of that size is permitted, or a private place whose owner has agreed;
- any notice, permit or authorisation the gathering needs under the law of the place where it happens, including notice to the authorities for a meeting in a public place where the law requires it;
- local rules on noise, alcohol, opening hours, use of public ground and public order;
- describing the drop honestly;
- not creating a drop for an activity that is illegal, dangerous or against section 9.
8.3. If you join a drop, you are responsible for yourself. You decide whether to go and what to do there. You are responsible for your own conduct, safety and belongings.
8.4. We do not check people. We do not verify the identity or the declared age of users, and during the test phase we do not verify their phone numbers either. We do not run criminal, background or any other checks. A confirmed proof means that other participants confirmed that a person was there. It says nothing about who they are or how they behave.
8.5. You may be meeting people you do not know. Meet in public, tell someone where you are going, do not share money or personal details with people you have just met, and leave if something feels wrong. Report anything that worries you (section 10). In an emergency, call the local emergency number first (112 in the European Union).
8.6. Proofs are not evidence. A proof and a badge are features of the app. They are not a certificate of anyone's whereabouts, identity or conduct, and we make no claim about their accuracy to anyone.
8.7. No gathering is guaranteed. A drop may go ahead and still not happen, or happen differently from how it was described.
9. Rules of conduct
9.1. These rules apply to everything you do on VOUCH and at any gathering you reached through it. Breaking them is a breach of these terms and may also be a crime.
9.2. Do not:
- use VOUCH to plan, promote or carry out anything illegal, including buying or selling drugs or weapons, theft, vandalism, trespass, or a gathering the law forbids;
- threaten, intimidate, stalk, harass or hurt anyone, online or in person;
- post or send sexual content, or make sexual advances towards anyone who has not welcomed them;
- involve anyone under 18 in a drop, a chat, a proof or a gathering, or help anyone under 18 use VOUCH;
- stage a proof, vouch for a proof you know is false, or help anyone fake presence;
- misrepresent a drop: a place, time, purpose or size you know is untrue;
- create a drop for something dangerous, including anything on roads, water, heights, or private property without permission;
- run a scam, ask for money or financial details, or advertise or sell anything;
- spam: repeated, automated or irrelevant drops or messages;
- post content that is hateful, incites violence, or discriminates against a person or a group;
- post, copy, screenshot or share outside the app other people's personal data, photographs, proofs or messages without their agreement;
- impersonate anyone, or claim an affiliation you do not have;
- interfere with the Service: no bots, scraping, reverse engineering, spoofed location, modified apps, or attempts to reach data the app does not show you.
9.3. Do describe drops honestly, show up when you join or leave the drop in time, and treat the people you meet as you would want to be treated.
9.4. These rules, the law and the rest of these terms are the only restrictions we place on what you may post or do. Where it is unclear whether something breaks them, a person decides, as section 10 explains.
10. Reporting, moderation and enforcement
10.1. How to report. You can report a drop or a person from the app. Anyone, whether or not they use VOUCH, can also report content by email to the address in section 1: say what the content is, where it is (the drop's name and date help), why you think it is illegal or against these terms, your name and email address, and confirm that you believe your report is accurate and complete.
10.2. Who decides. A person reads every report. We use no automated means to detect, assess or decide on content. Reports involving a minor, a threat to someone's safety or sexual content come first.
10.3. What we may do. Depending on what we find, we may take no action, remove or restrict content, close a drop, limit what an account can do, suspend an account for a period, or close it. We choose the least severe measure that deals with the problem, and we treat repeated or serious breaches more severely.
10.4. We tell you why. If we act against your content or your account, we tell you, through the app or the contact details we hold, what we did and for how long, the facts we relied on, whether a report triggered it, the rule or law concerned, and how to contest it. We do not do so where the law allows or requires otherwise, or where an authority asks us not to.
10.5. How to contest. Reply to our notice, or write to the address in section 1, within six months. Tell us why you think the decision was wrong. We look at it again and answer with reasons. If we were wrong, we reverse the decision as far as we can. Deleted chats cannot be restored. You can also go to court (section 19).
10.6. If you reported something. We let you know our decision where we have a way to reach you. We may answer several reports about the same thing together.
10.7. Misuse of reporting. Reports that are repeatedly and manifestly unfounded, or made to harass someone, break these terms. We may stop processing such reports and suspend the reporter's account.
10.8. Authorities. We comply with lawful orders of courts and competent authorities, including orders to remove content or to provide information we hold. If we become aware of information suggesting that a criminal offence involving a threat to someone's life or safety has taken place, is taking place or is likely, we inform the police.
10.9. No duty to monitor. We do not monitor chats and we do not pre-screen drops or proofs. We act on reports, on orders and on what we notice while operating the Service. We may look into something on our own initiative. Doing so does not make us responsible for anything we did not find.
11. Privacy and device permissions
11.1. The Privacy Notice explains what personal data we process, why, for how long, who processes it for us, what other users can see, and your rights. Where these terms and the Privacy Notice seem to differ on a question of personal data, the Privacy Notice prevails.
11.2. VOUCH asks for access to your location, camera and notifications when it needs them, and the app explains why at that moment. You can withdraw any permission in your device settings. The features that depend on it will then stop working.
12. Intellectual property and feedback
12.1. The app, its code, design, name, logo, drop visuals and everything else that is not your content belong to us or to those who license them to us. We give you a personal, non-transferable, revocable licence to install and use the app on your own device for its intended, private purpose while these terms apply. You may not copy, modify, distribute, sell or reverse engineer any of it, except where the law gives you that right.
12.2. If you give us feedback, ideas or suggestions about VOUCH, we may use them freely, without payment or credit. Feedback is not your content under section 7.
13. Third-party services
13.1. The Service relies on providers of hosting, maps and notification delivery, described in the Privacy Notice. They are not parties to these terms. We are responsible to you for the Service as a whole, within section 16.
13.2. If you install VOUCH from an app store, the store's terms also apply to the download. The store is not a party to these terms and is not responsible for VOUCH.
13.3. A gathering may take place at a venue run by someone else. Any agreement with that venue is between you and the venue.
14. Availability and changes to the Service
14.1. VOUCH is free. We try to keep it running, but we do not promise that it will be available at any particular time or free of errors. We may suspend it for maintenance or security, or because a service we depend on fails.
14.2. We may add, change or remove features. If a change removes something you rely on, we tell you in the app beforehand where we reasonably can. If the change also affects these terms, section 2.3 applies.
14.3. We may end the Service. After the test phase we will give at least 30 days' notice in the app, unless the law or a security event prevents it. During the test phase, section 4.3 applies. When the Service ends we delete user data, except what the law requires us to keep.
15. Suspension, termination and deletion
15.1. By you. You can delete your account at any time from the app, or by writing to us. It costs nothing and needs no reason, and it is also how you exercise any legal right to withdraw from this contract. Deletion is immediate and cannot be undone. Your profile, your proofs and their photographs are deleted, and your proofs leave every album. Some things you shared with others do not disappear at once: messages you sent stay in their chat, without your name, until the chat is deleted; a drop other people joined goes on without you; badges other people have already earned are not affected. Where a report concerns you or a drop you created, we keep limited data for a limited period after deletion, so that a report cannot be erased by deleting the account it concerns. The Privacy Notice and the app say what and for how long.
15.2. By us. We may suspend or close your account if you breach these terms, if the law or an authority requires it, if the account is used for fraud or abuse, or if we end the Service. Section 10 governs how we decide and how you can contest it. For a serious breach, or where waiting would put someone at risk, we may act first and tell you afterwards.
15.3. What ends. When your account closes, your licence to use the app ends and you lose access to your drops, chats, badges and albums.
15.4. What survives. Sections 7.3 (as far as we keep something), 8, 10.8, 12.2, 16, 17, 19 and 20 continue to apply after your account closes, together with anything else that by its nature should.
16. Our responsibility to you
16.1. What we are responsible for. We are responsible under the law for harm caused by our breach of these terms or by our fault. Nothing in these terms limits or excludes our liability for death or personal injury, for fraud, for wilful misconduct or gross negligence, or any other liability that the law does not allow to be limited or excluded, and nothing in them affects your rights as a consumer.
16.2. What is outside the Service. The Service is a free tool, in a test phase, through which users organise gatherings themselves (sections 4, 5 and 8). Within the limits of 16.1, we are therefore not responsible for:
- what happens at a gathering, or on the way to or from one;
- the conduct of any user, online or in person, or the accuracy of anything a user posts;
- the loss of chats, drops, proofs, badges or albums that results from how the Service is designed to work, or from a reset during the test phase;
- unavailability or errors of the Service, including failures of services it depends on, where we have taken reasonable care;
- loss that results from your breach of these terms, from your sharing of your sign-in code, or from a modified app or device;
- loss of profit, business or business opportunity, since VOUCH is for private use only.
16.3. Your rights for digital services. If you are a consumer in the European Union, you have legal rights regarding digital services, including the right to have the Service brought into conformity with these terms. They are not affected by this section.
16.4. No other promise. Except as stated in these terms and as the law requires, we give no promise that VOUCH is fit for any particular purpose or will meet your expectations.
17. Your responsibility for breaches
17.1. If a third party makes a claim against us, or an authority fines us, because of content you posted, a gathering you organised, or your breach of section 8 or section 9, you will compensate us for the loss we reasonably suffer as a direct result, including reasonable legal costs, to the extent that the loss was caused by your breach and not by ours.
17.2. We will tell you about any such claim promptly, let you take part in the defence, and not settle it in a way that affects you without consulting you.
17.3. This section does not apply to a loss we could have avoided with reasonable care, and it never makes you responsible for another user's conduct.
18. Transfer of these terms
18.1. We may transfer these terms, your account and the related data to a company or business that takes over the Service, provided it takes on all our obligations under these terms and the Privacy Notice and your rights are not reduced.
18.2. We will tell you in the app at least 15 days before the transfer, naming the new operator and its contact details. If you do not want to continue with the new operator, you can delete your account before the transfer takes effect.
18.3. You may not transfer your account or your rights under these terms to anyone else.
19. Law and disputes
19.1. These terms are governed by Italian law. If you live in another country of the European Union, you also keep the protection of the mandatory consumer rules of that country.
19.2. If you have a complaint, write to us first at the address in section 1. We aim to answer within 30 days.
19.3. If we cannot agree, you may bring a claim in the courts of the place where you live, or in Italy. If we bring a claim against you, we bring it in the courts of the place where you live. For users in Italy, the competent court is that of the place where the user lives or has elected domicile.
19.4. You may also use an out-of-court consumer dispute body approved in your country. We do not currently commit to any such body, and we take part in such a procedure only where the law requires it.
19.5. Nothing in this section prevents either of us from asking a court for urgent measures to protect a right.
20. General
20.1. Whole agreement. These terms, with the documents they refer to, are the whole agreement between you and us about the Service.
20.2. If a clause fails. If a clause is found invalid or unenforceable, the rest stays in force.
20.3. Not giving up a right. If we do not act on a breach, we can still act on it later, and on any other breach.
20.4. Language. These terms are written in English. If we publish an Italian version, it prevails for users in Italy where the two differ.
20.5. Notices. We contact you through the app, or by email if you wrote to us by email. You contact us at the address in section 1.
20.6. Version. These terms are version 1.0, dated 3 November 2026.
21. Specific approval of clauses
Under articles 1341 and 1342 of the Italian Civil Code, you declare that you have read and specifically approve the following clauses: 4.3, 4.4 and 4.5 (reset and end of the test, no continuity, confidentiality); 8.1, 8.4, 8.6 and 8.7 (gatherings organised by users, no checks on users, proofs not evidence, no gathering guaranteed); 10.3 and 15.2 (our right to restrict content and to suspend or close accounts); 14.1 and 14.3 (availability and end of the Service); 16.2 (what is outside the Service); 17 (your responsibility for breaches); 18.1 (transfer of these terms).
This approval is given separately from the acceptance of these terms as a whole, by a second confirmation in the app.
